Welcome to DT Globe Sia. These Terms of Service ("Terms") govern your access to and use of our real estate investment services, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the Services provided by DT Globe Sia, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you (the "User" or "Client") and DT Globe Sia (the "Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Eligibility and Account Registration

2.1 Eligibility Requirements

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our Services under applicable laws
  • Provide accurate, current, and complete information during registration

  • Immediately notify us of any unauthorized use of your account
  • Ensure that you log out from your account at the end of each session
  • Use a strong and unique password for your account
  • Not share your account credentials with any third party

Important: DT Globe Sia will never ask you to disclose your password via email, phone, or any other communication method. Any such request should be reported immediately to our security team.

DT Globe Sia provides comprehensive real estate investment services specifically designed for foreign investors seeking opportunities in Latvia and the broader European market. Our Services include, but are not limited to:

  • Legal and regulatory compliance assistance
  • Transaction facilitation and closing support
  • Property management coordination
  • Investment portfolio consultation
  • Residency permit application support related to real estate investment

3.2 Advisory Nature of Services

Our Services are primarily advisory in nature. While we provide professional guidance and support throughout the real estate investment process, all final investment decisions remain solely with the Client. We do not guarantee specific investment returns or outcomes.

3.3 Third-Party Services

Certain aspects of our Services may involve coordination with third-party service providers, including but not limited to legal professionals, property managers, financial institutions, and government agencies. While we carefully select our partners, we are not responsible for the actions or omissions of these third parties.

4. Client Obligations and Responsibilities

4.1 Information Accuracy

Clients must provide accurate, complete, and truthful information regarding:

  • Personal identification and contact details
  • Financial capacity and investment objectives
  • Legal status and eligibility to invest in real estate
  • Source of funds and compliance with anti-money laundering regulations
  • Any material changes to the above information

4.2 Due Diligence

Clients are responsible for conducting their own independent due diligence before making any investment decision. This includes, but is not limited to:

  • Reviewing all property documentation and disclosures
  • Obtaining independent legal and financial advice
  • Verifying property conditions through inspections
  • Understanding local market conditions and risks
  • Assessing personal financial capacity and risk tolerance

4.3 Compliance with Laws

Clients must comply with all applicable laws and regulations, including:

  • Latvian and European Union real estate investment regulations
  • Tax obligations in their country of residence and Latvia
  • Anti-money laundering and counter-terrorism financing requirements
  • Foreign investment and currency exchange regulations
  • Immigration and residency permit requirements

5. Fees and Payment Terms

5.1 Service Fees

Our service fees are determined based on the scope and complexity of services provided. Fee structures may include:

  • Initial consultation fees
  • Property search and identification fees
  • Transaction facilitation fees (typically a percentage of property value)
  • Ongoing advisory and management fees
  • Success-based fees for completed transactions

All fees will be clearly communicated and agreed upon in writing before services commence. Fee schedules are subject to change with 30 days' notice to existing clients.

5.2 Payment Terms

Payment terms are as follows:

  • Initial consultation fees are due upon scheduling
  • Retainer fees are due before commencement of services
  • Transaction fees are typically due at closing
  • Ongoing service fees are billed monthly or quarterly as agreed
  • All payments must be made in Euros (EUR) unless otherwise agreed

5.3 Refund Policy

Refunds are handled on a case-by-case basis. Generally:

  • Consultation fees are non-refundable once the consultation has occurred
  • Retainer fees may be partially refundable for unused services, minus administrative costs
  • Transaction fees are non-refundable once a transaction has been completed
  • Disputes regarding fees should be raised within 30 days of billing

6. Intellectual Property Rights

6.1 Company Property

All content, materials, and intellectual property provided through our Services, including but not limited to market analyses, property reports, investment strategies, website content, logos, and proprietary methodologies, are the exclusive property of DT Globe Sia and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services and related materials solely for your personal investment purposes. You may not:

  • Reproduce, distribute, or publicly display our materials without written permission
  • Modify, reverse engineer, or create derivative works
  • Use our materials for commercial purposes unrelated to your investment activities
  • Remove or alter any copyright, trademark, or proprietary notices

7. Confidentiality and Data Protection

7.1 Confidential Information

Both parties agree to maintain the confidentiality of all non-public information exchanged during the course of our business relationship. This includes:

  • Property details and transaction terms
  • Business methods and proprietary information
  • Personal data and identification documents

7.2 Data Protection

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and Latvian data protection laws. For detailed information about how we collect, use, and protect your data, please refer to our Privacy Policy.

7.3 Exceptions to Confidentiality

Confidentiality obligations do not apply to information that:

  • Is or becomes publicly available through no breach of these Terms
  • Is required to be disclosed by law or regulatory authority
  • Is necessary to disclose to third-party service providers for service delivery
  • Is disclosed with the express written consent of the disclosing party

8. Disclaimers and Limitations of Liability

8.1 No Investment Guarantees

Real estate investment involves inherent risks, and past performance is not indicative of future results. We make no guarantees or warranties regarding:

  • Investment returns or property appreciation
  • Rental income or occupancy rates
  • Market conditions or economic factors
  • Regulatory changes or tax implications
  • Successful completion of residency permit applications

8.2 Service Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, completeness, or timeliness of information
  • Uninterrupted or error-free service delivery
  • Results obtained from using our Services

8.3 Limitation of Liability

To the maximum extent permitted by law, DT Globe Sia and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Investment losses or property value depreciation
  • Actions or omissions of third-party service providers
  • Force majeure events beyond our reasonable control

Our total liability for any claims arising from or related to our Services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.

8.4 Indemnification

You agree to indemnify, defend, and hold harmless DT Globe Sia and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your investment decisions and their consequences
  • Inaccurate or misleading information you provide
  • Your infringement of any third-party rights

9. Termination

9.1 Termination by Client

You may terminate your relationship with us at any time by providing written notice. Upon termination:

  • You remain responsible for all fees incurred up to the termination date
  • We will provide a final accounting of services rendered
  • Ongoing obligations (such as confidentiality) continue after termination
  • We will return or destroy your confidential information as requested

9.2 Termination by Company

We reserve the right to terminate or suspend your access to our Services immediately, without prior notice, if:

  • You breach any provision of these Terms
  • You provide false or misleading information
  • Your actions pose legal or reputational risks to our company
  • You fail to pay fees when due
  • We are required to do so by law or regulatory authority

9.3 Effect of Termination

Upon termination of your account or Services:

  • Your right to access and use the Services immediately ceases
  • All licenses granted to you under these Terms terminate
  • Provisions that by their nature should survive termination remain in effect
  • Neither party is relieved of obligations incurred prior to termination

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of law provisions.

10.2 Negotiation and Mediation

In the event of any dispute arising from or relating to these Terms or our Services, the parties agree to first attempt to resolve the dispute through good faith negotiation. If negotiation fails, the parties agree to attempt mediation before pursuing litigation or arbitration.

10.3 Jurisdiction

Any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the courts of Riga, Latvia. You consent to the personal jurisdiction of such courts and waive any objection to venue.

10.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any written agreements between you and DT Globe Sia, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.

11.2 Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or through prominent notice on our website at least 30 days before the effective date. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

11.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11.4 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

11.5 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms or delegate any of our obligations without restriction.

11.6 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, government actions, or natural disasters.

11.7 Notices

All notices required or permitted under these Terms shall be in writing and delivered via:

  • Email to the address provided during registration
  • Registered mail to your address on file
  • Personal delivery with acknowledgment of receipt

11.8 Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.

12. Specific Terms for Foreign Investors

12.1 Regulatory Compliance

Foreign investors must comply with all applicable Latvian and European Union regulations regarding real estate acquisition, including:

  • Registration with the Latvian Land Registry
  • Compliance with foreign investment notification requirements
  • Adherence to anti-money laundering (AML) and know-your-customer (KYC) procedures
  • Obtaining necessary permits for property acquisition in restricted areas

12.2 Tax Obligations

Foreign investors are responsible for understanding and complying with all tax obligations, including:

  • Latvian property tax (real estate tax)
  • Capital gains tax on property sales
  • Rental income tax if applicable
  • Tax obligations in their country of residence
  • Double taxation treaty provisions

We strongly recommend consulting with qualified tax advisors in both Latvia and your country of residence.

12.3 Residency Permit Support

While we provide support and guidance for residency permit applications related to real estate investment, we do not guarantee approval of any application. The final decision rests with the Latvian Office of Citizenship and Migration Affairs (OCMA).

13. Anti-Money Laundering and Compliance

13.1 AML Policy

DT Globe Sia is committed to preventing money laundering and terrorist financing. We comply with all applicable AML regulations and require clients to:

  • Provide valid identification documents
  • Disclose the source of investment funds
  • Provide proof of address and financial capacity
  • Complete enhanced due diligence for high-value transactions
  • Cooperate with any compliance inquiries

13.2 Suspicious Activity Reporting

We are legally obligated to report suspicious transactions or activities to relevant authorities. We may suspend or terminate services if we suspect money laundering, terrorist financing, or other illegal activities.

13.3 Sanctions Compliance

We do not provide services to individuals or entities subject to international sanctions. Clients must confirm they are not on any sanctions lists and that their funds do not originate from sanctioned sources.
